APARTMENT ORTADA TERMS AND CONDITIONS

Please take the time to read these booking terms and conditions. This information is important and, in conjunction with a signed guest booking form forms your contract.

 

The contract is subject to these terms and conditions, all of which will apply to each and every booking made. Once the contract is made, it is the owners' responsibility to provide you with what you have booked, and it is your responsibility to pay for use of the apartment in full before you travel.

 

Please note that single sex parties or groups of young adults (under 25) will not be accepted. Due to the layout of the apartment, it may also be unsuitable for young children.

 

BOOKING

Once availability has been checked, a provisional booking of the apartment can be made. The signed booking form, together with the appropriate deposit, should be received within one week of the date that the booking form is issued to you. Only after the booking form has been received by email and the deposit received, will the booking be valid. Email confirmation of your booking will be sent to you once the form and reservation deposit have been received and a confirmation email will also follow once full payment has been made.

 

All relevant documentation will be sent to you via email, it is important to check carefully that all the details of your booking are correct once you receive it. The owners will not be responsible for any information you do not receive as a result of your failure to provide a valid email address.

 

TERMS OF PAYMENT

The completed booking form must be accompanied by a non-refundable deposit of 20% of the total booking price in order to secure the booking.

 

The balance of payment must be received no later than 10 weeks before the date of arrival. If the balance remains unpaid after the due date, the booking will be regarded as cancelled and any deposit paid will be retained.

 

Bookings made with 10 weeks before the date of arrival are subject to payment in full at the time of booking.

 

Payment should be made by bank transfer to the account details shown on the booking form.

 

All bookings will be subject to a security/breakage/damage deposit of £250.00 payable at the time of the balance payment. This deposit will be returned to you within one week of your return once clearance has been received from the management company.

 

The payment of the security/breakage/damage deposit in no way exempts you from your responsibility to take every care of your holiday accommodation. The property will be presented in good order and should be left as such. If any damage occurs (accidental, wilful, reckless, or otherwise) or the property is left in an unacceptable condition which requires additional cleaning, some or all of your security/breakage/damage deposit will be retained, and attempts made to recover any additional costs to rectify damage.

 

Please advise the maintenance company of any damage or breakages immediately so that items can be replaced.

 

TRAVEL INSURANCE

It is a condition of your reservation that you and all members of your party have insurance cover for the duration of your trip, and it is advisable that insurance is purchased at the time of booking to protect you against the possible loss of monies due to unforeseen cancellation. All policies should include full medical cover specific to the individual needs of each member of your party and the type of activities you and your party will be undertaking as part of your trip.

 

Please ensure that it provides adequate and suitable cover including medical expenses and emergency repatriation. The owners do not check individual insurance policies however they do reserve the right to request written details (insurer’s name, policy number and emergency contact number) of your policy.

 

CANCELLATION

By the guest

Any cancellation must be made in writing by the party leader and signatory on the booking form. Cancellation will be deemed to take effect from the date of receipt by the owner. Cancellation charges will apply as follows:

 

  • If the cancellation is 10 weeks or more before the arrival date the deposit will be retained.

  • If the cancellation is within 10 weeks of the arrival date, 100% of the total cost will be due.

 

If the apartment can be re-let for the same period, following a cancellation by the guest, monies paid may be refunded at the owners’ discretion.

 

Kindly ensure that you have the appropriate levels of travel insurance in place.

 

By the owner

In the very unlikely event that the owners are required to cancel the booking, all monies paid will be refunded to you and the owners shall be under no other liability.

 

CAPACITY AND AMENDMENTS

Only those named on the booking form may stay overnight in the apartment. The total number of guests allowed in the apartment at any one time is restricted to the number of guests scheduled, licensed by, and advised to, the local authority ahead of arrival. Should your party misrepresent themselves, you will be asked to vacate the apartment immediately without refund.

 

Under Turkish law, all guests need to be registered with the Jandarma for the duration of their stay. As such, copies of passports for all guests are required to be sent to the owners in advance of arrival date and no later than one week before to enable the management company to complete this administration exercise.

 

COMPLAINTS

Every effort will be made to ensure that you have an enjoyable holiday. If there is any cause for complaint, please let the management company know in the first instance and they will try to resolve the issue. If after that, you feel that the problem has not been resolved, please contact the owners without delay who will do their best to help resolve any justifiable complaints regarding the apartment. If you vacate the apartment before the end of the rental period without the owners’ authorisation, you will lose any rights to compensation.

 

LIABILITY

The owners shall not be responsible for the death or personal injury of the party leader, or any person named on the booking form or other person at the property.

 

The owners shall not be liable for any loss, breach or delay due to any cause beyond their reasonable control including though not limited to an act of God, explosion, flood, tempest, fire or accident, war or threat of war, civil disturbance, acts, restrictions, regulations, bye-laws, or measures of any kind on the part of any governmental or local authority, strikes, lock-outs, or other industrial actions or disputes or adverse weather conditions.

 

The owners cannot be held responsible for the breakdown of mechanical equipment such as pumps, boilers, swimming pool filtration systems etc nor for failure of public utilities such as water, gas, and electricity. No refund or rate adjustment will be made for unforeseen failures such as the supply of electricity, water, pool filtration systems, air conditioning, appliances, etc.

 

The owners are not responsible for noise or disturbance originating beyond the boundaries of the apartment or that which is beyond their control.

 

You and all other members of your party’s personal belongings and vehicles (together with their contents) are left at the apartment entirely at their own risk. The owners shall not accept any liability for any loss or damage to your (and all other members of your party’s) personal belongings and vehicles (including their contents) during your stay.

 

You are responsible for the apartment during the period of your occupancy and must observe all security precautions. Transportation (airport transfers, rental cars, and taxis) are supplied by third-party providers who operate independently. The owners assume no responsibility for any loss, injury, or damage to person or property because of the acts of the third-party providers.

 

You are advised to take out all relevant insurances usually covered by a travel insurance policy to an appropriate level of cover for your needs.

 

FORCE MAJEURE

In the event that the owners are forced by a “force majeure” to change or cancel your booking, any refunds are unable to be made.

 

The owners regret that they cannot accept any liability or pay any compensation where the performance by them or the prompt performance of their contractual obligations is prevented or affected, or you otherwise suffer any damage or loss as a result of “force majeure.”

 

In these terms and conditions, “force majeure” means any event which the owners could not, even with all due care, foresee or avoid. Such events include, but are not restricted to, war, threat of war, riots, civil strife, actual or threatened terrorist activity, industrial disputes, natural or nuclear disaster, volcanic activity, epidemics, pandemics, health risks, adverse weather conditions, fire, property destruction, closure of airports and all similar events outside of their control.

 

SAFETY

You agree to take care within the apartment and outside areas and consider the risks posed by swimming pools especially to children. The swimming pool should be accessed by the steps and not by jumping or diving in. Please supervise children at all times in and around the pool and beware of surfaces which often become slippery when wet.

 

MISBEHAVIOUR AND CONSIDERATION OF OTHERS

The owners reserve the right to terminate, without notice, the arrangements of any guest whose behaviour, is, in their opinion, likely to cause annoyance, distress, or danger to other residents within the complex or to any other third party. Parents/guardians are responsible for the supervision/behaviour of young children and teenagers.

 

You are asked to respect the need of others to have a quiet, pleasurable holiday and note that no house parties or functions are take place without advance permission of the owners.

 

CHECK IN

Check-in time is normally 3.00pm onwards and check-out is 11.00am unless you have made prior arrangements with the owners. The owners will try to be as flexible as possible, however, if guests are departing or arriving on the same day that you arrive or depart, it may not be possible to accommodate early check-ins or late check-outs. Final arrangements will be confirmed close to your arrival date.

 

​GUEST RESPONSIBILITIES

It is your responsibility to ensure that:

  • You obtain and meet any specific passport, visa, and health requirements.

  • All members of your party, including infants, have a valid passport.

  • You have adequate travel insurance in place to cover your holiday.

  • Please be advised that in the event that you or any of your party are disruptive or behave in an unsociable manner the owners do reserve the right to terminate your booking and will have no further liability or responsibility to you in respect of accommodation or transfer/car hire, nor will refunds be made.

  • During the period of the booking, you (personally and on behalf of all other people visiting the apartment) undertake (for the benefit of the owners) as follows:

    • that the number of people occupying the apartment will not exceed the number stated on the holiday confirmation.

    • that the apartment will be used solely for the purpose of a holiday.

    • to show due consideration for other parties (to include, but not limited to, refraining from abuses of the apartment and its communal areas and/or dangerous, offensive, or rude behaviour to the owners, their representatives or any third parties such as neighbours.

    • to keep the apartment and all furniture, utensils, equipment, fixtures and fittings in or on the apartment and its communal areas in the same state of repair and condition as at the commencement of the booking and to ensure that on your departure the apartment is left in the same state of order and cleanliness in which it was found. The owners reserve the right to charge you for any additional losses that are not covered by the security/breakage/damage deposit.

    • to report as soon as possible to the owners (or management company) any breakages or damage caused by you or any of your party members and to reimburse the owners with the cost of replacement if the amount in question exceeds the amount held as a security/breakage/damage deposit.

    • the owners reserve the right to make a claim against you for any repair, loss or additional cleaning as a result of damage caused.

    • not allow any person other than guests booked and staying in the apartment to use the facilities and amenities.

    • to notify all other members of the party of these undertakings.

    • you and all members of your party agree not to smoke or allow smoking inside the apartment under any circumstances.

    • please take care to secure the apartment at all times and take care of property keys.

    • the cost of any replacement keys will be deducted from your security/breakage/damage deposit.

  • In the event of a breach of any of the undertakings set out, the owners (or their representatives) can refuse to allow you to take possession of the apartment or ensure you and your party leave the apartment before the end of the booking. In either case, you shall be deemed to have cancelled the booking and you shall have no claim for compensation or reimbursement whatsoever. 

 

INDEMNITY

The owners reserve the right to terminate (before or after departure) your booking due to your or any member of your party’s misconduct, within the owners’ reasonable opinion. In these circumstances full cancellation charges apply and no refund will be given. Furthermore, the owners shall be under no obligation to pay compensation or meet any costs or expenses you may incur as a result of your apartment booking being terminated. You agree to indemnify the owners against any claims (including legal costs) made against them.
